Community Rights Counsel ("CRC") hails the Supreme
Court's ruling today in Brown v. Legal Foundation of Washington,
which upholds programs in virtually every state in the country
that provide critical funding for legal services for the indigent.
In the words of Doug Kendall, CRC's Executive Director, "today
is another bad day for the property rights movement. Washington
Legal Foundation had little to gain here except the satisfaction
of depriving poor people of desperately needed legal services.
The Court wisely rejected their claims."
Tim Dowling, CRC's Chief Counsel, added "as in last
year's Tahoe ruling the Court has seen through the empty legal
reasoning of property rights extremists."
Community Rights Counsel's brief in the Brown case, filed
on behalf of the National League of Cities, International
Municipal Lawyers Association, and the Trial Lawyers for Public
Justice, focused exclusively upon the ultimately dispositive
question of whether there could be a violation of the Just
Compensation Clause if no compensation is due.
