Community Rights Counsel and Citizens for
Responsibility and Ethics in Washington today filed the
attached petition for review of the order by Tenth Circuit
Chief Judge Deanell Tacha dismissing our complaint against
Judge Clarence Brimmer in the Roadless Rule case.
We argue that the Chief Judge was wrong in
concluding that we were inappropriately challenging Judge
Brimmers decision to preside over the
Roadless Rule case, because 1) there is no evidence that
Judge Brimmer ever even considered whether or not to recuse
himself, and 2) he hid from the parties the basis for seeking
his recusal.
Our petition will be considered by the full
Judicial Council of the Tenth Circuit.
